SC Verdict Changed the Constitution Without Due Process: Justice Hilali

Justice Mussarat Hilali of the Supreme Court expressed strong dissent against the majority verdict that awarded reserved seats to the Sunni Ittehad Council (SIC), stating it effectively altered the Constitution without following the proper amendment procedure. In her dissenting note, she argued that the decision undermined constitutional principles by granting seats to a party that hadn’t submitted a priority list or participated in elections under its current name. Justice Hilali emphasized that only Parliament has the authority to amend the Constitution, and the court should not bypass that process.
