LAHORE: The Lahore High Court has rejected a husband’s plea that he pronounced divorce to his wife “in jest,” ruling that such a claim cannot be used to prevent the legal divorce process.
Justice Anwar Hussain, in a 13-page judgment, upheld the Union Council’s certificate declaring the divorce effective.
The court said a wife cannot be left uncertain about her marital status and ruled that if a husband fails to inform the Union Council about a divorce, the wife can do so herself.
The court also held that Family Courts can determine whether a divorce has taken place and recommended amendments to the relevant divorce law.
A copy of the judgment was ordered to be sent to Family Courts across Punjab for guidance.
